Federal laws that every state must follow
Across the country, Medigap Plans A through N have to offer the same benefits, no matter which insurance company you buy from. That means if you look at Plan G from three different companies, the coverage will be the same every time.
If you are 65 or older and you sign up for Medicare Part B, you get a six-month Medigap Open Enrollment Period. During those six months, any company selling Medigap plans in your state has to offer you any plan they sell. They can’t reject your application or charge you more because of your health.

Indiana’s Medigap laws
For a long time, Indiana followed what the federal government required, but not much more. If you were under 65 and got Medicare because of a disability, Indiana only made companies offer you Plan A. And even then, those companies could charge you a lot more than they would charge someone older.
But that changed at the start of 2025.
Indiana passed a new law (Senate Enrolled Act (SEA) 215) that gives younger enrollees more choices. Now, insurance companies have to offer all Medigap plans to people under 65, including people with disabilities.
These people also now get the same six-month enrollment period when they first get Medicare Part B. During that time, companies can’t say no to them or raise the price because of health problems.
The law also sets some rules to provide fair pricing. For example:
- If you are under 65 and want Plans A, B, or D, the company can’t charge you more than what a 65-year-old would pay.
- If you want one of the other Medigap plans, the price can’t be more than double the amount a 65-year-old pays for that same plan.
- Companies are not allowed to make you wait to use the plan. They also can’t refuse to cover a pre-existing condition during that time.

Another change coming soon is Indiana’s new “birthday rule.”
Illinois and Oregon already let people switch their Medigap plans each year around their birthday. They don’t have to go through health checks or worry about getting turned down. Indiana did not have that rule before, but it is adding it now.
Starting January 1, 2026, thanks to a law called House Bill 1226, people in Indiana will be able to change their Medigap plan during a 60-day window that starts on their birthday. They will be allowed to switch to the same plan from another company, or a plan with fewer benefits, without going through medical underwriting.
